Regulations on the State institution

"Aksu District Department of Education"



                                             

1.General provisions

         1. The state institution "Aksu District Department of Education" (hereinafter referred to as the Department) is a state body of the Republic of Kazakhstan that provides guidance in the field of education.

         2. The Department has no departments.

 3. The Department carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.

4. The Department is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan accounts in the treasury bodies. 

5. The Department enters into civil law relations on its own behalf.

         6. The Department has the right to act as a party to civil law relations on behalf of the State, if it is authorized to do so in accordance with the legislation.

         7. The Department on issues of its competence, in accordance with the procedure established by law, makes decisions drawn up by orders of the head of the Department and other acts provided for by the legislation of the Republic of Kazakhstan.

8. The structure and the limit of the staffing of the Department are approved in accordance with the current legislation.

10. The full name of the state body is the state institution "Aksu District Department of Education".

         11. This Regulation is the constituent document of the Department.

         12. The Department's activities are financed from the republican and local budgets.

13. The Department is prohibited from entering into contractual relations with business entities for the performance of duties that are the functions of the Department.

 If a Hotel is granted the right by legislative acts to carry out income-generating activities, then the income received from such activities is directed to the state budget income. 





2. Mission, main tasks, functions, rights and obligations

 14. Mission of the Department: implementation of state policy in the field of education.

           15. Tasks:

 1) creating the necessary conditions for obtaining high-quality education aimed at the formation, development and professional development of the individual on the basis of national and universal values, achievements of science and practice;

 2) ensuring the improvement of the social status of teaching staff; 

 3) creation of special conditions for persons with disabilities to receive education;

4) to carry out other tasks within its competence in accordance with the legislation of the Republic of Kazakhstan.

16. Functions:

1) ensuring the provision of primary, basic secondary and general secondary education in accordance with the legislation of the Republic of Kazakhstan;

         2) organization of students' participation in the unified national testing;

         3) organization of accounting of preschool and school-age children, their education before they receive secondary education;

 4) making proposals on the creation, reorganization and liquidation of state educational organizations in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

         5) implementation of material and technical support of state educational organizations in accordance with the legislation of the Republic of Kazakhstan;

         6) organization of the purchase and delivery of textbooks and teaching materials by educational organizations implementing general educational programs of pre-school training, primary, basic secondary and general secondary education;

 7) provision of meterialno – technical base of regional methodical offices;

          8) providing additional education for children;

          9) ensuring the organization and holding of school olympiads and competitions of scientific projects on general education subjects, district-scale competitions;

10) the direction of funds for the provision of financial and material assistance to students and pupils of state educational institutions;

         11) organization of medical care for students and pupils of educational institutions, with the exception of preschool in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

 12) organization of free and preferential meals for certain categories of students and pupils in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan;

13) assistance in the employment of persons who have completed training in educational institutions;

 14) providing the necessary methodological and advisory assistance to families and organizations of preschool education and training;

15) implementation of educational monitoring;

          16) organization of the order and provision of educational organizations with forms of state-issued documents on education in accordance with the legislation of the Republic of Kazakhstan;

         17) implementation of staffing of state educational organizations;

18) providing methodological guidance to the psychological service in educational organizations;

19) issuance of a study permit in the form of an externship in organizations of basic secondary, general secondary education;

          20) implementation of other functions provided for by the legislation of the Republic of Kazakhstan;

17. Rights and obligations:

 1) submit proposals for consideration by the akim of the district and the district maslikhat on issues within the competence of the Department;

 2) to request and receive the necessary information in their activities from government agencies and other organizations;

3) to carry out the use of property located on the right of operational management;

 4) in accordance with the procedure established by law, consider the appeals of individuals and legal entities;

  5) to exercise other rights and obligations within its competence in accordance with the legislation of the Republic of Kazakhstan.



3. Organization of the activities of the state body



18. The management of the Department is carried out by the first head, who is personally responsible for the fulfillment of the tasks assigned to the Department and the exercise of his functions.

 19. The first head of the Department is appointed and dismissed by the akim of the Aksu district.

         20. The first head of the Department has no deputies.

         21. Powers of the first head of the Department:

 1) within its competence defines the duties and powers of the employees of the Department;

         2) in accordance with the current legislation, appoints and dismisses employees of the Department, directors of state institutions under the jurisdiction of the Department;

         3) in accordance with the procedure established by law, encourages and imposes disciplinary penalties on employees of the Department, directors of state institutions under the jurisdiction of the Department;

         4) within its competence issues orders, instructions, mandatory for execution by employees of the Department, directors of state institutions under the jurisdiction of the Department;

         5) counteracts corruption in the Department with the established personal responsibility for it;

         6) within the limits of its competence, represents the interests of the Department in state bodies and other organizations;

         7) exercise other powers in accordance with the legislation of the Republic of Kazakhstan;

8) organizes the work of the department on the formation of an anti-corruption culture within its competence

          The execution of the powers of the first head of the Department during his absence is carried out by the person replacing him in accordance with the current legislation.



4. Property of the state body

                                               

         22. The Department may have a separate property on the right of operational management in cases provided for by law.

         The property of the Department is formed at the expense of the property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.

23. The property assigned to the Department belongs to communal property.

         24. The Department does not have the right to independently alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by law.



                  

5. Reorganization and abolition of the state body



25. Reorganization and abolition of the Department are carried out in accordance with the legislation of the Republic of Kazakhstan.

1) municipal state institution "Secondary school-gymnasium named after Kanysh Imantaevich Satpayev" of the Aksu district Department of Education;

          2) municipal state institution "Zhurmbek Sydykov Secondary School with a preschool mini-center" of the Aksu district Department of Education;

 3) municipal state institution "Esmurat Sikhimov Secondary School with a boarding school" of the Aksu district Department of Education;

         4) municipal state institution "Mamania Secondary School with preschool mini-center" of the Aksu district Department of Education;

         5) municipal state institution "Secondary school named after Barlybka Syrttanov with a preschool mini-center" of the Aksu district Department of Education;

          6) municipal state institution "Gali Ormanov Secondary School with preschool mini center" of the Aksu district Department of Education;
